Does MoCRA Apply to You?

The Handcrafted Soap and Cosmetic Guild recently released a new section on their webssite which includes a comprehensive guide to the Modernization of Cosmetic Regulations Act of 2022 (MoCRA) and a wizard to help you determine what you need to do to comply with the regulations.

The implementation of the requirements is spread out over the next few years to allow time for the FDA to get the details and regulations worked out and published.

Some of the requirements go into effect as of December 29, 2023!

There are portions of MoCRA that apply to ALL cosmetic manufacturers, big or small. The good news is that most of these requirements are fairly straight-forward and easy to implement.

The other good news is that the harder portions of MoCRA — good manufacturing practices and registering your business and products — have a small business exemption. So if you are a small business (annual revenue of under $1 million per year) and you don’t make any of the high-risk cosmetics they list, then you would be exempt from the GMP regulations (when they are issued) and registering your facility and products.
